Waste Clearance Holland Park Terms and Conditions

These Terms and Conditions set out the basis on which Waste Clearance Holland Park provides waste collection and related services to domestic and commercial customers. By placing a booking, accepting a quotation, or allowing our team to carry out a collection at your premises, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following words have the meanings given below:

Customer means any individual, business, partnership or organisation that requests or receives services from Waste Clearance Holland Park.

Services means the waste collection, removal, loading, transportation, disposal, recycling, and any related services provided by Waste Clearance Holland Park.

Waste means any items, materials, rubbish, junk, furniture, appliances, garden waste, construction waste or other materials that the Customer asks us to remove, subject to applicable waste regulations.

Agreement means the contract between the Customer and Waste Clearance Holland Park formed in accordance with these Terms and Conditions.

2. Service Area

Waste Clearance Holland Park primarily operates within Holland Park and surrounding areas. Acceptance of a booking is subject to confirmation that the collection address is within our feasible service area and that our vehicles can safely access the property.

3. Booking Process

3.1 Customers may request a quotation or make a booking by phone, email, online enquiry form, or any other method we make available.

3.2 When requesting a quotation, the Customer must provide accurate and complete information, including the collection address, access details, type and approximate volume or weight of waste, and any special requirements.

3.3 Any quotation given before our arrival is an estimate only and is based on the information provided by the Customer. The final price will be confirmed on site once our team has inspected the waste.

3.4 A booking is only confirmed when we have accepted the order, agreed a date and time window for collection, and communicated confirmation to the Customer. We reserve the right to decline any booking at our discretion.

3.5 The Customer must ensure that a responsible adult is present at the property at the time of collection to grant access, confirm the items to be removed, and authorise any changes to the agreed service or price.

4. Access and Parking

4.1 The Customer is responsible for ensuring safe and reasonable access to the collection point, including arranging any necessary parking permits or authorisations for our vehicles.

4.2 If adequate access or parking cannot be obtained, we may be unable to complete the collection. In such circumstances, we may charge a call-out or aborted journey fee to cover our costs.

4.3 If the collection requires the team to remove items from upper floors, basements, or confined spaces, the Customer must inform us in advance so that we can assess safety and staffing requirements.

5. Our Services

5.1 Waste Clearance Holland Park will collect and remove Waste from the Customer’s premises and will dispose of or recycle it in accordance with applicable waste regulations and environmental best practice.

5.2 The Services do not include deep cleaning, disconnection of gas, electrical or plumbing fixtures, demolition work, or structural alterations, unless expressly agreed in writing.

5.3 We reserve the right to refuse to remove any items that we reasonably consider unsafe to handle, unlawful to transport, or prohibited by waste disposal and environmental regulations.

6. Prohibited and Restricted Items

6.1 The Customer must not present for collection any hazardous, toxic, explosive, corrosive, flammable or otherwise dangerous materials, including but not limited to asbestos, chemicals, solvents, gas cylinders, fuel, clinical or medical waste, and certain electrical components, unless we have expressly agreed in writing and are properly licensed to handle such materials.

6.2 If prohibited Waste is discovered during collection, we may refuse to remove it, and we may charge for any time spent on site and any costs incurred in making the area safe.

6.3 The Customer is responsible for informing us in advance if they believe any Waste may be hazardous or subject to special handling requirements.

7. Pricing and Quotations

7.1 Our prices are generally based on the volume of Waste collected, weight, type of materials, labour required, access conditions, and disposal or recycling costs.

7.2 Any indicative prices given by phone, email or online are estimates only and are subject to confirmation by our team on arrival following inspection of the Waste.

7.3 If the actual volume, weight, or type of Waste differs from the Customer’s description, we may adjust the price accordingly. The Customer will be informed of any change before work is carried out and may accept or decline the revised price.

7.4 All prices are quoted exclusive of VAT unless clearly stated otherwise. VAT will be charged at the applicable rate where required by law.

8. Payments

8.1 Payment is due on completion of the collection unless we have agreed alternative terms in writing in advance.

8.2 We may accept payment by cash, debit or credit card, bank transfer, or other methods that we notify the Customer about from time to time.

8.3 Where we provide an invoice with agreed credit terms, payment must be made within the period stated on the invoice. We reserve the right to charge interest and reasonable debt recovery costs on overdue amounts.

8.4 If the Customer fails to pay any amount due, we may suspend further Services until payment is received or may cancel future bookings.

9. Cancellations and Amendments

9.1 The Customer may cancel or rearrange a booking by contacting us during our normal business hours.

9.2 If the Customer cancels a booking with at least 24 hours notice before the agreed arrival time, no cancellation fee will normally apply.

9.3 If the Customer cancels less than 24 hours before the agreed arrival time, or if our team attends the property and is unable to carry out the collection due to lack of access, parking, or the Customer’s absence, we may charge a cancellation or aborted journey fee to cover our costs.

9.4 We will use reasonable endeavours to attend at the agreed time, but time is not of the essence. In the event of delays caused by traffic, weather, vehicle issues, or other circumstances beyond our control, we will inform the Customer as soon as reasonably practicable and rearrange the collection if necessary. We shall not be liable for any loss arising from such delay.

10. Customer Responsibilities

10.1 The Customer warrants that they are the owner of the Waste or have the owner’s authority to arrange its removal.

10.2 The Customer must ensure that items to be removed are clearly identified and separated from items that are to be retained.

10.3 The Customer must take all reasonable steps to ensure the safety of our team while on their premises, including notifying us of any hazards, fragile structures, or other risks.

10.4 The Customer must not present for collection any items that are stolen, unlawfully obtained, or subject to a third party’s rights, without full disclosure and proper authority.

11. Liability and Damage

11.1 Waste Clearance Holland Park will take reasonable care when carrying out the Services. However, the Customer acknowledges that some minor scuffs or marks may occur when moving bulky items through tight spaces, stairwells, or doorways.

11.2 We shall not be liable for minor cosmetic damage to walls, floors, doors, or fixtures that is reasonably incidental to the normal performance of the Services, provided we have acted with reasonable care.

11.3 If significant damage to property is caused by our negligence, the Customer must notify us in writing as soon as possible and in any event within seven days of becoming aware of the damage. We may request photographs and reasonable access to inspect the damage.

11.4 Our total liability for loss or damage arising under or in connection with the Agreement, whether in contract, tort, or otherwise, shall be limited to the amount paid or payable by the Customer for the relevant Services, except where such limitation is not permitted by law.

11.5 Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded or limited.

12. Waste Transfer and Environmental Compliance

12.1 Waste Clearance Holland Park will handle, transport, and dispose of Waste in accordance with applicable UK waste regulations and environmental legislation.

12.2 Where required, we will issue appropriate documentation such as waste transfer notes to evidence lawful transfer of Waste from the Customer to our control or to an authorised facility.

12.3 We may separate materials for recycling and may deliver Waste to one or more authorised facilities. Title to the Waste passes to us upon loading, unless otherwise agreed.

12.4 The Customer agrees to cooperate with any reasonable requests for information required to comply with waste regulations, including descriptions of the type and origin of Waste.

13. Insurance

13.1 Waste Clearance Holland Park maintains appropriate insurance cover for its operations, including public liability insurance at levels we consider suitable for the Services provided.

13.2 Details of our current insurance cover are available on request.

14. Complaints

14.1 If the Customer is dissatisfied with any aspect of the Services, they should contact us as soon as possible, providing full details of the issue.

14.2 We will investigate complaints in a fair and timely manner and will aim to resolve them by repair, replacement, partial refund, or other appropriate remedy, where justified.

15. Force Majeure

15.1 We shall not be in breach of the Agreement or liable for delay in performing, or failure to perform, any of our obligations if such delay or failure results from events, circumstances, or causes beyond our reasonable control. These may include but are not limited to extreme weather, traffic disruption, accidents, vehicle breakdown, industrial disputes, or public emergencies.

15.2 In such circumstances, we may suspend the Services for the duration of the event or, where necessary, cancel the affected booking and offer to rearrange when reasonably possible.

16. Data Protection and Privacy

16.1 We will collect and process personal information about Customers only to the extent necessary to provide the Services, manage bookings, process payments, and meet our legal obligations.

16.2 We will handle personal data in accordance with applicable UK data protection legislation and will take reasonable steps to keep such data secure.

17. Variation of Terms

17.1 Waste Clearance Holland Park reserves the right to amend these Terms and Conditions from time to time. The version in force at the time of the Customer’s booking will apply to the Services for that booking.

17.2 Updated Terms and Conditions may be made available on request or via our standard communications.

18. Severability

18.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.

19. Governing Law and Jurisdiction

19.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Services shall be governed by and construed in accordance with the laws of England and Wales.

19.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Waste Clearance Holland Park.

20. Entire Agreement

20.1 These Terms and Conditions, together with any written quotation or order confirmation provided by us, constitute the entire agreement between Waste Clearance Holland Park and the Customer in relation to the Services and supersede any prior discussions, correspondence, or understandings.

20.2 The Customer acknowledges that they have not relied on any statement, promise, or representation not set out in these Terms and Conditions or in the written quotation or order confirmation.
